Should i rescue her ?

Hi, For the past few months ive watched a poor little foal (2yr) being beaten and neglected in the gypsy tiny field just across from my yard. The little filly is stunning and has lovely movement, however her rib cage and wither are showing quite badly. When she was around (1yrs) they begun to break her to drive and were chasing the poor thing around with a massive whip, then had the cheek to ask my friend to break him to ride (she said no as he was only a baby). It makes me really sad to watch this poor little girl gradually starving and tbh i don't think she will last very long. I have tried my best to contact the RSPCA but their defense was " the pony has water and hay so there is nothing we can do" I really think that she could become such a lovely horse in the future as shes just so loving and REALLY WANT TO BUY HER, but in the long-term it makes me think has her having such a bad start to life effected her both mentally and physically.... What do you think ?
